KTSM | Catholic Diocese of Las Cruces gets more support from border communities in fight over Mount Cristo Rey property

A federal judge in New Mexico has ruled the U.S. government can deposit money into a court as part of a plan to seize land from the Catholic Diocese in Las Cruces.

But Judge Kenneth J. Gonzales also ruled the Diocese can still challenge the Trump administration’s decision to take a portion of its property abutting the U.S.-Mexico border.

The Diocese, in a recent court filing, opposed a request from the Trump administration to immediately seize the land. Attorneys for the diocese said the proposed new barrier on its land is contrary to Catholic values and teachings.

Attorneys for the Diocese argue the government’s desire to take the property without judicial review infringes on the right to “the free exercise of religion.”
